For UP ByPolls 2024, voting is to be held on 9 assembly seats in Uttar Pradesh on 20th November. Earlier, Allahabad High Court has given its verdict on the petition of Irfan Solanki, who was MLA from Sisamau seat. The decision of the Division Bench of Allahabad High Court has come on the petition of Irfan Solanki.
The suspense of the by-election being held on Sisamau seat of Kanpur is over. The way for by-election on Sisamau seat has been completely cleared.
Outgoing MLA Irfan Solanki did not get relief from Allahabad High Court. Allahabad High Court refused to stay the trial court’s order convicting Irfan Solanki and sentencing him to 7 years’ imprisonment. However, the court has approved the bail of Irfan Solanki in this arson case.
Irfan Solanki’s membership of the Assembly will not be reinstated if the trial court does not stay the decision of his conviction. In such a situation, the by-election there will not be affected at all and voting will take place at the scheduled time on November 20.
Irfan Solanki had challenged the order of the trial court in the High Court. A request was made to stay the trial court’s order until the final verdict. On the other hand, the UP government has filed an appeal in the High Court demanding that the 7-year sentence given to Irfan be increased to life imprisonment.
