Her enraged sons Robert and Joseph Balducci have taken their lawsuit against the nursing home to Suffolk County Supreme Court. Commenting on the case, DeNoto said, “Did the nurse follow the criteria for determining whether or not a person is dead and did the doctor confirm what the nurse found? There is literally no excuse for placing a living person in a body bag and sending them to a facility for mortuary preservation.

Janet lived at Water’s Edge for just a few months and several weeks after falling in her own home on Aug. 1, 2022. “This is a really sad case,” DeNoto said. “The ultimate goal is to send a message that you have to take your job seriously and you have to treat human beings with respect and dignity.”
