The Supreme Court on Wednesday upheld the conviction and life imprisonment of a constable. The policeman was found guilty of killing his wife’s lover in the police station. Hearing the petition of the policeman, a bench of Justice Sudhanshu Dhulia and Justice Rajesh Bindal rejected the argument of convict Surendra Singh that the deceased had come to kill him and he fired in self-defense, killing the victim. The bench said that ‘this is nothing but murder. The nature of the weapon used, the number of bullets fired at the deceased, the part of the body where the bullets were fired, all point to the fact that the appellant had planned to kill the deceased.’

Order to surrender within four weeks

The apex court refused to interfere with the judgments of the trial court and the Delhi High Court and set aside the interim order granting bail to the convict. The bench said, “This appeal is dismissed. The interim order dated April 2, 2012 granting bail to the appellant is deemed to be quashed and the appellant is directed to surrender before the trial court within four weeks from today. A copy of this judgment shall be sent to the trial court to ensure that the appellant surrenders and undergoes the remaining portion of his sentence.”

According to the prosecution, the victim had an illicit relationship with the convict’s wife and the victim was shot dead at the Mayur Vihar police station on June 30, 2002. The victim and the convict were last seen talking to each other inside the police station. Also, witnesses – including other police personnel at the police station – saw the convict killing the victim with his official 9-mm carbine.
