Prayagraj News: Allahabad High Court has canceled the order and notice of the Tehsildar on the case of demolition of Radha Swami Satsang Bhawan located in Dayalbagh, Agra. The court said, the principles of natural justice were not followed while ordering the demolition of the Satsang Bhavan. The court has given permission to pass orders in this case after hearing the petitioner’s side afresh.
The single bench of Justice Manish Kumar Nigam passed this order while hearing the petition filed by Radha Swami Satsang Sabha. The hearing in this case had already been completed, after which the court had reserved the decision after the hearing on October 16 itself.
The petitioner gave this argument in the court
It was said in the petition that the petitioner was not given an opportunity of hearing, while he had sought 15 days’ time to respond to the notice, but An opportunity was given to file the reply on 24th September itself at 4 pm. Along with this, it was also said that the Tehsildar did not consider the objections of the petitioner while making the order.
Reply given by the state government
In this matter, the state government said that the building of Radha Soami Satsang was built by encroaching on the government land, due to which the demolition action was taken. Has been done. The petitioner said that the land which has been forcibly vacated is in the name of Satsang Sabha. The administration has used bulldozers arbitrarily and lathi charge was also done on satsangis.
A copy of all the agreements, lease deed orders made from 1935 to 2012 was attached with the petition. Along with this, the reply to the Tehsildar’s notice dated 19 September 23 and the revenue records of the concerned plots were also attached in the petition. Apart from Khasra Khatauni, other revenue records and answers of more than two dozen pages, photographs of the fight with the police were also put up by the government.
