Porsche car accident case: Pune Police files 900-page chargesheet

Pune police have filed a 900-page chargesheet in the Porsche car accident case nearly two months after it happened. Initially, the Juvenile Justice Board (JJB) had granted bail to the son of a real estate developer soon after the incident and directed him to write a 300-word essay on road safety. Following severe criticism, the police again approached the JJB, following which a revised order was issued, under which the accused juvenile was sent to an observation home.

Apart from the accused’s parents and hospital staff, the police also detained his grandfather in connection with the incident. Two more people were then arrested for allegedly acting as a middleman and assisting in financial transactions between the accused doctors and the teenager’s father.

Bombay High Court ordered release

On June 25, the minor involved in the incident was released from the observation home following an order of the Bombay High Court. By then, the accused had been in the observation home of the Juvenile Justice Board for about 36 days. The Bombay High Court had termed the order to send the minor to the observation home as illegal and emphasized that the law related to juveniles should be followed completely. The High Court said that justice should be given priority above everything else.

In this case, the high court directed the authorities to release the minor on bail and not to keep him with any grandparents as directed by the magistrate while granting him bail on May 19. While releasing the minor on bail, a two-judge bench of Justice Bharati Dangre and Justice Manjusha Deshpande said, “We are bound by the law, the objects and purposes of the Juvenile Justice Act and we must treat him as any child in conflict with the law irrespective of the gravity or heinousness of the offence.”

The state government has given permission to Pune Police to go to the Supreme Court

Meanwhile, the state home department gave permission to Pune police to move the Supreme Court to challenge the Bombay High Court order. According to Additional Commissioner of Police (Crime) Shailesh Balkavade, we had submitted an application to the state government on June 26 stating that there is a need to challenge the High Court order on certain grounds. The government gave its approval to file a special leave petition (SLP) on Saturday and we will soon file such a petition in the Supreme Court.
