Parliament should pass law on reservations to exceed 50-pc cap: Congress

The Congress on Sunday said Parliament should pass a law to increase the reservation cap to 50 per cent, a day after the opposition party demanded that the reservation cap in Bihar be included in the Ninth Schedule.

The National Executive of the Janata Dal (United) met on Saturday. In which the party expressed concern over the recent decision of the High Court. In which the reservation limit of Scheduled Caste (SC), Scheduled Tribe (ST) and Other Backward Classes (OBC) of Bihar government was increased from 50 percent to 65 percent. A political resolution was also passed in the meeting. In which JDU requested the BJP-led central government to put the state law in the Ninth Schedule of the Constitution, so that the possibility of its judicial review can be ruled out.

In a post on X, Congress general secretary Jairam Ramesh said, during the Lok Sabha election campaign, the opposition party has been saying that all state laws related to reservation for SCs, STs and OBCs should be included in the Ninth Schedule.

He said, it is good that JD (U) has raised this demand in Patna yesterday. But its ally BJP is completely silent on this issue both in the state and at the Centre. The former Union minister said, bringing reservation laws beyond the 50 percent limit into the Ninth Schedule is also not a solution, because according to the 2007 Supreme Court verdict such laws are subject to judicial review. He said that a Constitution Amendment Act is needed for this.

He said, in such a situation, the only way for the Parliament is to pass the Constitution Amendment Bill, so that the reservation for SC, ST and OBC can exceed 50 percent.
