The Bombay High Court quashed the Maharashtra government’s order suspending the registration process of construction workers due to the election code of conduct. The court said that no legal work should be stopped during the election code of conduct. However, activities related to election campaign may be banned.
‘Operation of government schemes should continue without any hindrance’
A bench of Justice Somasekar Sundarsen and Justice Arif Doctor gave this order on November 6. The court said, there is no such provision in the code of conduct, which would interfere in the ongoing legal proceedings. The court also clarified that only political gatherings and campaign activities can be prohibited during the election code of conduct. But the operation of government schemes should continue without any hindrance.
Labor unions filed petition in the High Court
This order of the High Court came after the Maharashtra government had suspended the registration of construction workers and other welfare schemes due to the election code of conduct. Many labor unions had filed a petition against this in the High Court. It was said in the petition that due to this suspension the workers are not getting their rights and money.
‘Registration process of construction workers should continue throughout the year’
The court said that the registration process of construction workers should continue throughout the year, so that the targets set by Parliament can be met. The court also said that no new policies or changes in schemes can be made during the election code of conduct. But the old welfare works should be continued.
With this order, the High Court canceled the notice issued by the Maharashtra government and said that public publicity and activities should be limited to the minimum level. Also, these activities should not be associated with any kind of political function or campaign.
