Minimum number to form government is 138

According to the Constitution of Nepal, Oli will have to get a vote of confidence from the Parliament within 30 days of assuming office. It is expected that Oli will do this easily, as the minimum number to form a government in the 275-member House of Representatives is 138.

Nepal has had 14 governments in the last 16 years

Earlier, the leader of Nepal’s largest communist party was appointed Prime Minister by President Ramchandra Paudel on Sunday. Oli will lead a coalition government with the Nepali Congress (NC), the largest party in Parliament, and other smaller parties. 14 governments have been formed in Nepal in the last 16 years. He has replaced Pushpa Kamal Dahal ‘Prachanda’, who could not get the trust vote in the House of Representatives last week.

There will also be a hearing in the Supreme Court

Within hours of Oli’s swearing-in ceremony, three advocates Deepak Adhikari, Khagendra Prasad Chapagen and Shailendra Kumar Gupta filed a writ petition in the Supreme Court of Nepal. In this, they challenged Oli’s appointment as PM and called it unconstitutional. They argue that if the government formed according to Article 76 (2) fails the floor test in the House of Representatives, then the President should be invited to form a new government under Article 76 (3). The Supreme Court has fixed July 21 as the date for hearing this case.
