Delhi HC asks dda to grant 1 month for vacating mosque premises

Delhi News: The Delhi High Court has issued a new directive to the Delhi Development Authority (DDA) and the local religious committee regarding vacating the premises of the mosque and madrasa located at Hazrat Nizamuddin. The court has directed that the caretakers of the mosque and madrasa be given one month’s time to vacate the premises. In fact, DDA has decided to demolish these two premises.

The High Court said, “In view of the undertaking given by the caretaker of the petitioner before the court, the religious committee and DDA are directed to give one month’s time to the petitioner.” The court has also asked the petitioners to adhere to this deadline. Justice Amit Sharma’s vacation bench made it clear in the order issued on Wednesday that the petitioner Faizyab Masjid and Madrasa or any other person claiming through it will not be given any more time to vacate the premises.

The court said, the petitioner should not deny the statement
The mosque and madrasa are located near the ISBT bus depot in Sarai Kale Khan of Hazrat Nizamuddin. The court also recorded the statement of the caretaker of the mosque who said that he will vacate the premises within a month and will not stop the demolition of the premises. The court has instructed him not to retract his statement.

The petitioner demanded that the demolition act be declared unconstitutional
The High Court was hearing a petition seeking to declare the notice issued by Delhi Police and Delhi Development Authority officials on June 13 to demolish the mosque as illegal, arbitrary and unconstitutional. The Delhi Religious Committee (DRC) has decided to remove unauthorized religious structures from public land. The committee is being represented in the court by advocate Arun Pawar.
