Delhi court convicted rape accused and said Consent of minor does not matter

Delhi News: A court in the national capital Delhi convicted a man for raping a 14-year-old girl in January 2015. The court said that if physical relations are made with a minor, then it would be a crime of rape and consent does not matter in such cases.

Additional Sessions Judge Amit Sehrawat was hearing a case against a man who was charged under the penal provision of rape and Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. Special Public Prosecutor Vineet Dahiya appeared for the prosecution.

The court noted the consistent and credible statements of the girl about getting pregnant due to voluntarily having physical relations with the accused and later giving birth to the child. The court rejected the argument of the defense lawyer that the girl was an adult at the time of the incident. The court said that according to the evidence, she was about 14 years old.

What else did the court say?
The court further said that the defence has already accepted the prosecution’s case to the extent of physical relations. Thus, if physical relations are established with a minor girl, it fully falls under the definition of rape and penetrative sexual assault and consent does not matter in the case.

The court said that according to the DNA report, the accused is the biological father of the girl. The court said that the accused has been found guilty of rape and penetrative sexual assault. The court will hear the arguments related to the duration of the sentence later.
