In the case of the death of eight newborns due to fire in Vivek Vihar’s Baby Care New Born Child Hospital, Delhi Police has filed a chargesheet in the court against the owner and two doctors. In this, the police has said that despite the approval of five beds, treatment was being done on 12 beds in the hospital. Neither fire safety arrangements were made in the hospital nor qualified doctors were appointed.

A chargesheet has been filed against the hospital owner Dr Naveen Khichi and Dr Akash. Chief Judicial Magistrate (CJM) Vidhna Gupta Anand of Karkardooma Court has listed the case for hearing on August 2. A copy of the chargesheet has been given to the lawyers of the accused, Naveen and Akash. The accused were produced in the court after the judicial custody period ended. Lawyers Naveen Kumar Singh and Satyam Singh argued on behalf of the accused. The police arrested Dr Naveen on May 26 and Akash on May 27.
In the chargesheet, the police mentioned 81 witnesses and 10 important flaws
- The license received from DGHS in 2021 expired on March 31. Five beds were approved, but 12 were installed.
- There was no mention of fire safety in the license application. Nothing was found installed even at the time of the fire.
- 50 square feet of space is required for one nursery bed. There were two rooms on the first floor, which were insufficient for 12 beds.
- For nursery, a doctor with PG degree and DMC certificate is required, which was not there.
- GNM degree, registered with DNC and one year experience in a 10 bedded ICU hospital was required.
- Under the license, 20 oxygen cylinders were to be kept, but 31 were found. The cylinders were kept in a dangerous manner and they exploded.
- During police interrogation, the staff admitted that they did not have the required degree to work in a children’s nursery.
- The hospital owner had allowed the male staff to cook food on the roof. The nursing staff had warned them, but it had no effect.
- The fire was not caused by a short circuit, but how it started could not be ascertained. Reports have been filed from all departments.
- Waste and wooden scraps were kept towards the emergency gate of the nursing home, which caused the fire to break out.
