Bhojshal ASI Survey Report: The survey report of Bhojshala located in Dhar was presented by ASI in front of Indore High Court Bench of Madhya Pradesh on Monday (22 July). This case was heard in the High Court today. This hearing took place in Indore High Court in front of the bench of Justice Sushrut Arvind Dharmadhikari and Justice Duppala Venkat Raman.

After seeing the report, the High Court said that since this matter is already pending in the Supreme Court and there is a stay on the implementation of the survey report. In this case, when the Supreme Court removes the stay on the survey report, then the High Court will give its decision in this matter.

The High Court is waiting for the order of the Supreme Court
After which, everyone’s eyes are now fixed on the order of the Supreme Court in this entire matter. The next hearing in this case is to be held in the Supreme Court on July 30. Earlier, the Supreme Court has said in one of its orders that before taking any action on the basis of the survey report, it should be brought to the notice of the Supreme Court. Only after that a decision should be taken on this matter.

This is the reason why Indore High Court has asked to wait for the next direction of Supreme Court even after the ASI report is presented. Let us understand what is the whole matter?

What did the Muslim side say?
In fact, in the Bhojshala case in Dhar, the Muslim side says that the Indore High Court has ordered a survey without listening to its side. The Muslim side has put forth its point in the Supreme Court, stating that the Hindu side went to court against the 2003 order and the petition filed by the Muslim side in 2019 was ignored.

In this way, the High Court issued a warrant without hearing the petition. According to the petition filed by the Muslim side in 2019, some work is being done illegally in Bhojshala located in Dhar. During this, it was claimed in the court that the things of ancient importance kept here were brought and kept later.

ASI accused of not following guidelines
At present, the hearing on this petition is yet to take place. After this, on April 20, the Muslim community filed a contempt petition in the Supreme Court in the Bhojshala case. In this petition, it has been argued that the guidelines were not followed in the survey being conducted by the Archaeological Department and Bhojshala was vandalized.

After this, the Supreme Court issued a notice to the Archaeological Survey of India (ASI). The next date of hearing in this case has not been decided, but it is to be heard. ASI has recently submitted the report of the survey conducted for 3 months in the Indore High Court.

On the other hand, a petition was filed in Jabalpur High Court in 2004 by the Muslim side, which has not been resolved yet. In this petition, the 2003 order of the court was challenged. Apart from this, in 2019, the Muslim side filed another petition in which objection was raised on other items taken inside Bhojshala for worship.

Hindu side demanded to declare it a temple
About 3 years after the petition was filed in 2019, the Hindu side filed another petition in 2022. In which there was a demand to declare Bhojshala as a temple. In this, it was demanded that the Hindu side should be given the right to worship for the whole day and Namaz should be postponed.

In this way, two petitions of the Muslim side are currently pending for hearing. Regarding the entire issue, the Muslim side says that no decision has been taken on the petitions that are pending for hearing. In such a situation, how can the court give a decision on the petition of 2022.

The Hindu side rejected the claim of the Muslim side
In the Bhojshala case, Hindu Front for Justice advocate Vishnu Shankar Jain released a video saying that the idols found there were found during the ASI survey and were not placed there earlier. The allegations of the Muslim side in this case are absolutely wrong.

He said that the Muslim side is talking about going to the International Court of Justice, but the rule is that only one country can go to the International Court of Justice, not any individual or organization. Apart from this, the Hindu side has also presented some facts.

‘Petition was not filed to stop the survey’
Ashish Goyal, state vice-president of Hindu Front for Justice and petitioner in the Bhojshala case, said that no petition has been filed in the Supreme Court yet against the report of the scientific survey of ASI. Ashish Goyal said that the case is already going on in the Supreme Court.

According to Ashish Goyal, the Muslim side had already filed a petition in the Supreme Court to stop the survey. The last hearing of which was held on 1 April 2024, in which the Supreme Court has banned any implementation of the ASI survey report without the cognizance of the Supreme Court.

In this case, Ashish Goyal further said that the reply has been given to the notice issued by the Supreme Court on April 1. Our lawyer Vishnu Shankar Jain has requested the Supreme Court for a hearing to lift the stay on implementation. He said that very soon the matter will come up in the Supreme Court.
