SC stays HC order for CBI inquiry into alleged irregularities in appointments in Jharkhand Assembly

The Supreme Court on Thursday stayed the Jharkhand High Court’s decision ordering the Central Bureau of Investigation (CBI) to probe alleged irregularities in appointments and promotions in the state assembly. The petition was filed on behalf of Jharkhand Assembly and others, on which a bench of Justices B.R.Gavai and K.V. Vishwanathan’s bench agreed to hear. In the petition, the High Court’s decision of 23 September was challenged.

What was said in the petition

It was said in the petition that the High Court ordered the CBI to investigate without any criminal case. This is a civil case. The state police and investigating agency are capable of investigating the case and the direction to hand over the investigation to CBI is not correct. It also said that there is no FIR registered in this matter nor is there any criminal case on the basis of which investigation should be initiated. The petition also said that there is no evidence of money laundering in the case and no fraud has been confirmed.

‘High Court did not pay attention to the Commission’s report’

It was mentioned in the petition that the Jharkhand Assembly Secretariat had started the recruitment process in 2003 and thereafter the process of appointments and promotions was done properly. Later, some persons allegedly recorded the conversation about irregularities in the appointment process, which was presented to the Jharkhand Assembly Speaker. The petition also said that a committee was formed to investigate the matter in 2007 and the commission submitted its report in 2018. The High Court did not pay attention to this report and did not take appropriate action on this report. The Supreme Court will now hear this case next on November 21.
